Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using www.amalficoastvacation.org (the “Site”) operated by Amalfi Coast Vacation (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.amalficoastvacation.org.

Definitions

• The words “you” and “your” refer to the user of the website or Amalfi Coast Vacation’s services or the person on whose behalf such person accesses or uses the website or services.
• The words “Photographer” and “Photographers” refer to the independent photographers selected by Amalfi Coast Vacation and assigned to you after making a reservation on Amalfi Coast Vacation’s website.
• The words “Third Parties” refer to selected third parties who may offer related services, including but not limited to, providers of print products and merchandise. For clarity, we will have the sole right to select these Third Parties.

By clicking the “Accept” button or using the Site in any manner, including but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions.

We will make every reasonable effort to provide the services in accordance with the descriptions provided on our website. While it is unlikely that we will need to make changes to your booking or cancel confirmed bookings, we reserve the right to do so if necessary or advisable. If we need to cancel your booking, we will provide you with a credit that you can use for another booking or a full refund at our discretion. We will not be obligated to provide you with a reason for canceling your booking.

General Information

This Agreement governs the use of the Amalfi Coast Vacation website and services, including online booking of photographers, participation in a photoshoot with the assigned photographer, downloading digital image files, ordering prints online, and participating in promotions managed by Amalfi Coast Vacation.

To access the Services, you must be at least 13 years old. If you are under 18, you must obtain permission from a parent or guardian to use the Services.

We reserve the right to withhold the Services at any time if we believe that you have not complied with any of the provisions of these Terms. Your user data and some other information about you are subject to our Privacy Policy. You acknowledge and agree that by using the Services, you consent to the collection and use of such information.

Amalfi Coast Vacation acts as an agent between you and independent photographers in destinations across the Amalfi Coast. Amalfi Coast Vacation has a working relationship with the photographers, and they provide services to Amalfi Coast Vacation. All photographers are independent professionals and run their own photography business in their city. You are not entitled to request any information from us about the photographers beyond what we provide for the purposes of using the Services.

Our Services

You are invited to view Amalfi Coast Vacation’s portfolio online before making an online booking. To book, you will be directed to complete payment for the selected service.

Within a reasonable time after receiving payment, we will contact the independent photographer at the selected destination, confirm the date and time, and coordinate the service you have booked. We will provide you with a booking confirmation and relevant details. This confirmation will include information such as the confirmed date and time of the photoshoot and the meeting location. Amalfi Coast Vacation will not be liable for any reliance or expectation on your part regarding the services of a particular photographer listed on the Local Lens website.

During your photoshoot, you have the option to extend the length of the photoshoot. By communicating this preference to the Photographer, you will be required to pay for the extra time before receiving your photos. Payment will be made via an online link. If you book extra time, every 30-minute increment will be charged at an additional rate of 150 Euros, and you will receive 15 additional photos for each 30-minute increment of shooting time. 30 minutes is the minimum time extension for a shoot. Payment for the extra time must be received before the photos are delivered. If payment is not received, photos from the entire session will be withheld.

The photographer may professionally retouch the selected photos based on their professional judgment and capabilities and upload them to an independent server designated by Amalfi Coast Vacation. After receiving notification from the photographer that the completed photos have been uploaded to the server, Amalfi Coast Vacation will forward you a link to access your photos. Amalfi Coast Vacation is not responsible for the security of the links to your photos or the duration of accessibility to such links.

If you arrive more than 10 minutes late to your session, all the time from the original start time will be lost, and you may shoot for the remaining time you have booked. The number of photos delivered may be adjusted to reflect the actual time spent together. Delays or waiting times due to traffic or city events may occur, so both photographers and clients should plan accordingly. You might consider contacting your photographer in advance to determine the possibility of any delays.

Booking a Service

All photoshoot bookings are offered based on the availability of photographers. To ensure a photoshoot, you must book at least 5 days in advance. If you wish to book during peak times (such as weekends or holidays), you should book further in advance. Bookings are not final until you have received the confirmation email with the photoshoot details, photoshoot location, and meeting point. The dates provided at the time of online booking are not always fixed. Although rare, there are always events beyond our control that will require us to communicate further with you to arrange a different time suitable for both you and your Photographer. We do not guarantee the availability of a particular photographer or the shooting area for your photoshoot.

Communications between you and us will use electronic means, whether you visit the Amalfi Coast Vacation website or send us emails, or whether we post notices on the Amalfi Coast Vacation website or communicate with you via email. For contractual purposes, (a) you consent to receive communications from us in electronic format; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if they were in writing.

It is your responsibility to ensure you correctly enter your email address and other contact details when completing the photoshoot booking process on the website. Failure to do so may cause the loss or misdelivery of the confirmation email for your experience. If you do not provide your correct email address, we will not be liable for any damages you suffer as a result of not receiving our communications or Services. Additionally, we will not be liable for any damages you suffer as a result of not receiving our communications where such failure to receive is caused by our emails being quarantined in spam or junk folders or other factors beyond our control. If you do not receive a confirmation email within an hour of booking, please contact us at info@amalficoastvacation.org to ensure we have the correct contact details.

Refund Policy

Services canceled by you for any reason:

• If you cancel more than 14 days before the photoshoot date, we will refund you 100% minus the payment processor fee of 3%.
• If you cancel less than 14 days before the photoshoot, we will refund you 80%.
• If you cancel 7 days or less before the photoshoot, we will refund you 60%.
• If you cancel 72 hours or less before the photoshoot, we will refund you 30%.
• If you cancel 24 hours or less before the photoshoot or do not show up for the photoshoot, no refund will be given.

Weather Policy

Amalfi Coast Vacation photoshoots can be conducted at any time of the year, rain or shine. The photographer may, at their discretion, change the photoshoot location to better capture your photos considering the weather. If you are unwilling to accommodate an alternative location or timeslot offered by your photographer due to the weather forecast, the regular cancellation policy will apply. If the photographer has no alternative availability or locations and the weather poses too great a risk, you will be refunded 50% minus the 2.9% credit card processing fee and any transportation costs already incurred by the photographer (tickets, ferries, etc.).

Note: Some hotels or private gardens do not admit photographers, and you will need to arrange to meet the photographer in a nearby public space or pay an extra permit fee for the photographer. If you think your hotel or private garden might apply these fees, please check before booking the photoshoot. If you book and later discover that there is a strict no-photos policy, the photographer will offer to reschedule or provide alternative locations. If you are unable to reschedule and unwilling to go to an alternative location, the photoshoot will be considered a last-minute cancellation, and no refund will be offered.

Pricing

All prices listed on the Local Lens website are in euros (€). Applied prices may vary based on exchange rate fluctuations. We have no control over the exchange rates set by financial institutions and assume no responsibility for the conversion rate used.

Additional Costs

You are responsible for covering any additional costs and expenses related to your choice of location (transportation, parking, entrance tickets, etc.). If you want the assigned photographer to join any activities, you will also need to cover their expenses. You can add extra time if the photographer is available; additional time is charged at a rate of 150 euros for 30 minutes. Amalfi Coast Vacation reserves the right to charge such additional costs as applicable.

Copyright Information

The photographer retains all copyright on all images. The client has a perpetual, non-exclusive, non-transferable, non-sublicensable license to use the photos for personal use only and in no event can use the images for commercial use, profit, or competition.

The rights granted in the preceding paragraph are subject to the following conditions:

• Always attribute any electronic copy of the image as follows: “[Site name], used under license.”
• No alterations will be made to the images without the photographer’s consent as they may misrepresent the photographer’s work to the public.
• Take reasonable measures to protect the image from data corruption.
• Do not use the work in a derogatory manner.
• Do not otherwise violate the copyright of the image.

We respect the intellectual property rights of others and ask that you do the same. If you are a copyright owner or an agent thereof and find content that infringes on your copyright, you can notify us with the following written information:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works on a single online site are covered by a single notification, a representative list of such works on that site;
3. Identification of the material that is claimed to be infringing;
4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address;
5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Any content that may infringe on the copyright on a photographer’s profile constitutes an infringement by the photographer. Amalfi Coast Vacation is not responsible for the infringement of content that photographers or anyone else uploads to their profile on their behalf.

Modifications to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. These policies apply to current and future purchases; should there be any changes to this agreement, they will replace the old terms and apply to services already booked and services booked in the future. Should there be discrepancies elsewhere on amalficoastvacation.org, these terms prevail and take authority over any statements yet to be updated on the website.
